NSW Dividing Fences Act
The NSW Dividing Fences Act 1991 is important for anyone building a boundary fence. It establishes that neighbours must equally share the cost of a “sufficient dividing fence.” Before starting work, you must serve a written Fencing Notice on your neighbour outlining the proposed work and cost. They have 30 days to respond.
If you want a fence that exceeds the “sufficient” standard — for example, Colorbond when basic timber would suffice — you can still proceed but may need to pay the difference. The fencing contractors in our network understand the Act and can help you navigate the process.
Pool Fencing Regulations in NSW
NSW has strict pool fencing requirements under the Swimming Pools Act 1992 and AS 1926.1. All swimming pools and spa pools must be enclosed by a compliant barrier. Key requirements include:
- ✓Minimum height of 1.2 metres above finished ground level
- ✓No climbable objects within 900mm of the fence
- ✓Self-closing and self-latching gates that open outward from the pool
- ✓Maximum gap of 100mm between vertical bars and under the fence
- ✓Non-climbable zone (NCZ) requirements on the outside of the fence
- ✓Pool fencing must be registered and inspected
Non-compliance can result in fines and prevent you from selling or leasing your property. The fencing contractors in our network are experienced in compliant pool fencing installation.
